We represented a young father in private children proceedings.
During the initial meeting, the father informed us that he was not allowed unsupervised contact with the child and was only allowed 1-2 hours of contact when the mother allowed contact to take place. He felt the mother was using the child to control contact and that at times he felt he was a secondary parent. He came to Higgins Miller as he did not know his legal rights and was frustrated and upset at not seeing his child, even though he had Parental Responsibility as his name was on the child’s birth certificate.
We represented the father at the initial hearing, FHDRA, where we were able to finalise the matter. The outcome resulted in our client being granted unsupervised fortnightly weekend contact as well as weekly Wednesday contact for a few hours; with Christmas and birthday contact confirmed as well.
The father was extremely happy to have contact increased with an order in place that would limit disputes between the parents (which had been very stressful) but also allow the child to know her paternal side of the family.
