Separation Agreements & Consent Orders

There can be a great deal of confusion about exactly what is meant by Separation Agreements (sometimes referred to as Legal Separation), Clean Break Orders or Consent Orders.

What are Separation Agreements and Consent Orders?

In a nutshell, it’s a document you make when you no longer want to live together as a couple. The document sets out your arrangements regarding your assets including property, pensions, businesses, savings and investments. Also subject to the consent order agreement could be maintenance for children, or indeed for a former partner. No two cases are exactly alike so everything, even debts, needs to be legally considered, legally documented and mutually agreed on.

If there are divorce proceedings then these financial issues will inevitably form a major part of the settlement agreement or divorce consent order. If there is no divorce action then you may choose to leave divorce proceedings for at least two years when a divorce can be obtained with no blame attached to either party.

Although a consent order such as this principally applies to married couples, it is also relevant to unmarried couples who need to agree on how their financial assets will be divided.
