Financial Disclosure, Form A and Form E

Financial disclosure is an important part of any divorce or separation involving financial matters. It is the process where both parties provide full and honest details of their finances so that a fair financial settlement can be reached.

What is Financial Disclosure?

Financial disclosure allows both parties to clearly understand the financial circumstances of the other. Without full disclosure, it is difficult to negotiate a fair agreement or for the court to make informed decisions.

Disclosure can take place voluntarily between solicitors or as part of court proceedings. It is essential that all information provided is accurate and complete, as failing to disclose assets or financial information can have serious consequences and may lead to agreements being overturned in the future.

Financial disclosure commonly includes:

What are Form A and Form E?

Form A is the document used to start financial remedy proceedings through the court. This application asks the court to deal with financial matters following a divorce or separation if an agreement cannot be reached voluntarily. Once Form A has been issued, the court will set a timetable for the case and arrange hearings to assist the parties in resolving matters.

Form E is the detailed financial statement completed by both parties during financial remedy proceedings. This document provides a full overview of your finances and requires supporting documents such as bank statements, property valuations and pension information. The court relies on the information contained within Form E to understand each party’s financial position and determine what outcome may be fair.
