In a nutshell, a separation agreement or consent order is all about reaching and signing an agreement with your spouse or partner to determine the best and most fair financial settlement between the two of you that is binding.

If there is property involved this will in all probability be your biggest financial asset, but also under consideration could be the value of pensions, businesses, savings and investments.  Also subject to the consent order agreement could be maintenance for children, or indeed for a former partner. No two cases are exactly alike and so everything, even debts, need to be legally considered, legally documented and mutually agreed upon.

If there are divorce proceedings then these financial issues will inevitably form a major part of the settlement agreement or divorce consent order. If there is no divorce action then you may choose to leave divorce proceedings for at least two years when a divorce can be obtained with no blame attached to either party.
