Parental responsibility sounds like something that we all know about but actually more than 20 years after the legal concept was introduced many parents still do not know what it is, how you get it or why it is important. It is often only after they have been to see us at Higgins Miller Solicitors that parents actually have the answers to those questions.
Parental Responsibility (PR) is the legal recognition of parent’s rights, responsibilities and duties for their child. Without Parental Responsibility a parent has no automatic right to information from their child’s school like school reports and there is no obligation for them to be consulted about important decisions that affect the children such as health and education.
All mothers have parental responsibility. Married fathers and fathers named on a child’s birth certificate (if the child was born after 1st December 2003) also automatically have it. Other fathers can only obtain it by either a Parental Responsibility agreement or court order.
At Higgins Miller Solicitors we can help and advise in relation to Parental Responsibility and how to get it. We can prepare a Parental Responsibility agreement or represent you in an application to court. Our aim is to give you good, practical advice. Legal Aid may be available but where it is not we will discuss with you how to fund your case in a way that best suits you.
