We have noticed a significant increase in cases which involve facebook. It has cropped up in cases about children and divorce when a client has discovered something about an ex-partner on facebook and has then brought this to us as evidence of their behaviour.
This has been the topic of a recent article in the guardian which includes details of American research which found that 4 out of 5 family lawyers had seen an increase in the number of divorce cases citing facebook and two-thirds said it was the ‘primary source’ of evidence in divorce proceedings.
Our advice to clients is to use facebook with caution and avoid sharing details that you would not want others (including your former partner) to know.
