Who will make decisions for you and about you and look after your personal and financial matters if you cannot do so?
A Lasting Power of Attorney (LPA) appoints someone to handle and administer your affairs even if you cannot do so. There are two types of LPA: one that deals with your property and financial affairs and one that deals with your health and welfare.
Both provide an opportunity for you to elect who will look after and manage your affairs in the event that you are no longer able to do so.
The Property and Finance Lasting Power of Attorney can be effective once it has been registered with the Office of the Public Guardian so that your attorney can administer your financial affairs for you even though you could do so yourself.
Alternatively, it can be written so that it only becomes effective after registration and then only if you are unable to administer your affairs yourself because of mental incapacity.
An attorney appointed under a Health and Welfare Power of Attorney can only act after registration and then only if the donee (the person making theLasting Power of Attorney) cannot do so by virtue of mental incapacity. Our solicitors can discuss with you which LPA best suit your needs and guide you through the process of who to appoint (it may be more than one person) and what they should and should not be allowed to do. Above all, they can help you achieve certainty as to how your affairs will be looked after if you cannot manage.
It may be too late to make decisions like this after you may have suffered a decline in your health, by then you may not be able to prepare a LPA and decisions will instead have to be taken by third parties called Receivers.
After preparing your LPA we will help you through the process of having it signed taking care of all the certificates that have to be completed before arranging for its registration.
If required we can also help you with an Advance Directive (or Living Will) setting out details of the medical treatment that you would not want to receive in the event that you were unable to make those decisions. We can talk through with you about medical treatments that you may not want to receive in certain conditions ensuring that your wishes are respected even if you are not able to communicate them. Discussions like this can of course be difficult but with our years of experience, we will guide you through the process with understanding, care and compassion.
