Katie Price and Alex Reid announce their plans to divorce

Katie Price and Alex Reid have announced that they plan to divorce after marrying in Las Vegas in February 2010.

Because they have been married for less than a year they will have to wait to issue divorce proceedings. The law in England and Wales prohibits any divorce petition being presented to the court when the parties have been married for less than 12 months.

When they do present their petition they will have to do so on the grounds of either unreasonable behaviour or adultery. They can only divorced by mutual consent after having been separated for two years.

It is as yet unclear whether they signed a pre-nuptial agreement prior to the marriage although the consensus seems to be that they did not. This means that he may be entitled to half of her estimated £30 million fortune.

Pre-nuptial agreements are a fast changing topic at the moment and although they have historically not been recognised by the English courts this looks set to change.
